Delegation of Governor’s Powers under "The Gold Fields Act Amendment Act, 1868," to the Superintendent of the Province of Auckland.

NORMANBY, Governor.

WHEREAS by an Act of the General Assembly of New Zealand, intituled "The Gold Fields Act Amendment Act, 1868," it is enacted that it shall be lawful for the Governor, if and whenever he shall have, by lease, agreement, or otherwise, by consent of the Native owners of any land over which the Native title has been extinguished, or the Native owners of any land over which the Native title has not been extinguished, obtained power from such Native or other owners to authorise entry on such lands for mining for gold, by Proclamation issued under the third section of "The Gold Fields Act, 1866," to include such land within any gold field, or to proclaim such land a gold field: And by the said Act it is further enacted that it shall be lawful for the Governor in Council, under his hand and the Public Seal of the colony, from time to time to delegate to the Superintendent of any province, or to such other person as the Governor may deem fit, all or any of the powers vested in the Governor by the preceding sections of the said Act (including the above in part recited section), subject or not to any limitations or restrictions as the Governor may think fit, and in like manner to alter and revoke any such powers:

Now therefore, I, George Augustus Constantine, Marquis of Normanby, the Governor of New Zealand, with the advice and consent of the Executive Council of the colony, in pursuance and exercise of the power for that purpose vested in me by the said Act, do hereby delegate to

Sir GEORGE GREY, K.C.B.,
as Superintendent of the Province of Auckland, all the powers vested in the Governor by the said in part recited section of "The Gold Fields Act Amendment Act, 1868," to be exercised by him within the Province of Auckland, so long as he shall continue and remain Superintendent of the said province, and no longer: Provided always that no Proclamation affecting any lands shall be made by the said Sir George Grey under the powers hereby delegated to him, unless the Governor shall have obtained power to authorise entry on such lands for mining for gold, in the manner required by the said Act.

Given under the hand of His Excellency the Most Honorable George Augustus Constantine, Marquis of Normanby, Earl of Mulgrave, Viscount Normanby, and Baron Mulgrave of Mulgrave, all in the County of York, in the Peerage of the United Kingdom; and Baron Mulgrave of New Ross, in the County of Wexford, in the Peerage of Ireland; a Member of Her Majesty’s Most Honorable Privy Council, Knight Commander of the Most Distinguished Order of Saint Michael and Saint George; Governor and Commander-in-Chief in and over Her Majesty’s Colony of New Zealand and its Dependencies, and Vice-Admiral of the same; and issued under the Seal of the said Colony,
at the Government House at Wellington, this thirteenth day of April, in the year of our Lord one thousand eight hundred and seventy-five.

Delegation of the Governor’s Powers under "The Quartz Crushing Machines Regulation and Inspection Act, 1872," to the Superintendent of the Province of Auckland.

NORMANBY, Governor.

WHEREAS by an Act of the General Assembly of New Zealand, intituled "The Quartz Crushing Machines Regulation and Inspection Act, 1872," it is, amongst other things, enacted that it shall be lawful for the Governor in Council, under his hand and under the Public Seal of the colony, from time to time to delegate to the Superintendent of any province all or any of the powers vested in the Governor by the said Act, and in like manner to revoke or alter any such delegation: Provided, however, that any such Superintendent shall only hold and exercise the powers vested in him by any such delegation within the limits of his province: Provided that all fines, fees, and penalties to be imposed under the said Act shall be declared by the Governor in Council, and also that all regulations made by virtue of such delegation shall be approved by the same authority:

Now therefore, I, George Augustus Constantine, Marquis of Normanby, the Governor of the Colony of New Zealand, with the advice and consent of the Executive Council of the said colony, in pursuance and exercise of the power and authority for that purpose vested in me by the said Act, do hereby delegate unto the Superintendent of the Province of Auckland all the powers vested in the Governor by the said Act.
