FORM No. 2.
To the owner or reputed owner lessee or reputed lessee and occupier of allotment number

Take Notice that the Highway Board intend to take such land as is required for a ____ road.

And of which proposed road the specifications plans and Sections are deposited in the office of the said Board at ____ (where situated). And you are hereby required to state whether you assent dissent or are neutral in respect of taking such land.

When made, the order must be sent to the Superintendent for his approval. No further step can be taken till this approval is obtained, but when obtained the Board may proceed.

The assessment list, as finally settled by the Board under the Highways Act 1871, is the basis for assessing the amount to be paid by each person liable.

So much of this List as comprises the names of the persons on whom the rate is levied must be copied into a book to be kept for that purpose to be called the “Separate Rate Book,” and the amount payable by each ratepayer inserted opposite his name.

Such entry must be certified under the hands of the Chairman and two other members of the Board, and the book must be open to the inspection of any ratepayer of the District at all reasonable times.

The amount of a separate rate must not exceed one shilling in the pound of the annual value or one penny in the pound of the value to sell. More rates than one may be levied in like manner in the same year provided their aggregate amount does not exceed the amount specified viz. one shilling in the pound of the annual value or one penny in the pound of the value to sell.

The rate must be paid as required by section 42 of the Highways Act 1871 and if not so paid may be recovered as therein provided.

Money raised for a special rate can only be expended for the purpose for which the rate is levied.
FORM No. 3.
Highway Board
At a meeting of the ____ Highway Board held this ____ day of ____ 18 ____ .
It appearing that the period of forty clear days has elapsed since the Specifications Maps Plans and Sections of the proposed Road from ____ (Description)
were deposited at the office of the Board and since Notice thereof was published in the Provincial Government Gazette and that no objections to the making of the said Road have been made by any person (or all objections and evidence have been duly heard) and it appearing expedient to the said Board to proceed with the making of the said Road.
It is ordered that the said Road be made in accordance with the said Specifications Maps Plans and Sections; and
It is further ordered that a copy of this order together with true copies of the said Specifications Maps Plans and Sections so deposited as aforesaid be transmitted to His Honor the Superintendent the said order being first published in the Provincial Government Gazette and in the Daily Southern Cross pursuant to the thirty-third section of “The Highway Boards Empowering Act, 1871.”

STEPS to be taken by Highway Boards for levying separate rates, under “The Highway Boards Empowering Act, 1872.”

When it appears to a Highway Board that any work or improvement is for the special benefit of any particular portion of a Highway District, a separate rate may be levied for defraying the cost.

Public notice in some newspaper usually circulated in the District must be given of the intention to levy such a rate, at least one calendar month before it is levied. The Notice may be in the form “A.”

If within the month a protest in writing signed by at least one half of the ratepayers of that portion of the District to be specially taxed, reckoned according to their votes, is left at the office of the Highway Board, the rate cannot be levied.

If no such protest is so left, a special order distinctly defining the portion of the district on which the rate is to be levied and fixing the amount of the rate may be made by the Board. This order may be in the form “B.”

When made, the order must be sent to the Superintendent for his approval.
FORM “A.”
Highway District.
Notice is hereby given that in pursuance of “The Highway Boards Empowering Act 1872” the Highway Board intend to levy a separate rate not exceeding in the pound (of the annual value or value to sell) on all that portion of the District as is described at the foot of this Notice for the purpose of (describe work or improvement to be made).

FORM “B.”
Highway District.
It appearing to the Highway Board of the District of ____ that the construction of a (describe work or improvement) is for the special benefit of that particular portion of the said District as is described at the foot of this order, the said Highway Board do by this special order make and levy a rate of (specify amount of rate) to be called a separate rate on all the rateable property situated within that portion of the District above-mentioned and hereunder described.
