314 AUCKLAND PROVINCIAL GOVERNMENT GAZETTE.

I hereby certify that I have examined the Accounts of the Provincial Treasurer of the Province of Auckland for the quarter ended the 30th September, 1872, and compared them with the vouchers and find the computations correct; that the Revenues and Receipts brought on charge and required by law to be paid into the Provincial account were so paid; that all issues of public monies have been made on Warrants of the Superintendent duly certified by me; that all monies issued in payment of services rendered were legally available according to the terms of the Provincial Audit Act, 1866; that the expenditure shown in the said accounts has been properly classified, and that any part thereof which may have been incurred without the authority of law is separately shown, with the exception on the whole of the above statements as respectively specified below; and I further certify that the amount of such special order does not exceed the amount authorised by the 2nd clause of The Provincial Audit Act Amendment Act, 1868.

IN accordance with the provisions of "The Diversion of Roads Act, 1863," the following Bill intended to be introduced into the Provincial Council at its next Session, is published for general information.

Ihumatao.

Auckland, October 18th, 1872.

An Act to close up a certain road at Ihumatao in the Parish of Manurewa in the County of Eden in the Province of Auckland and to authorize the Governor to grant the land occupied by the said road to James Ellett of Ihumatao aforesaid settler.

PREAMBLE.

Whereas it is expedient to close up the road mentioned and described in the Schedule "A" to this Act annexed. And whereas the said road so to be closed up as aforesaid passes through certain land the property of the said James Ellett. And whereas it is expedient that the land occupied by the said Road should be granted to the said James Ellett his heirs and assigns in fee simple. Be it therefore enacted by the Superintendent of the Province of Auckland by and with the advice and consent of the Provincial Council thereof as follows:—

ROAD IN SCHEDULE "A" TO BE CLOSED.

  1. From and after the passing of this Act the said Road mentioned and described in the Schedule "A" to this Act annexed shall be closed.

LAND MAY BE GRANTED TO JAMES ELLETT.

  1. It shall be lawful for His Excellency the Governor of New Zealand to grant the Land occupied by the said Road to the said James Ellett his heirs and assigns in fee simple.

SHORT TITLE.

  1. The Short Title of this Act shall be "The Ihumatao Road Act, 1872."

SCHEDULE "A."

A road one hundred links wide bounding native allotment number six situated in the Ihumatao Block County of Eden on the west and bounding native allotment number seven situated in the said Block on the East and leading from a public road bounding said native allotments six and seven on the north to allotment one hundred and sixty-nine A as the said road is delineated on the plan intituled "Ihumatao Road Act, 1872," deposited in the Waste Lands Office at Auckland and therein distinguished by being colored Brown and marked Road.

THE POVERTY BAY STANDARD will shortly be issued at Gisborne, and, having promise of a good circulation, offers a capital opportunity for advertising.

I, the undersigned, WALTER SULLY, hereby make application to register "THE HYDE PARK GOLD MINING COMPANY, REGISTERED," under the provisions of "The Mining Companies’ Limited Liability Act, 1865," and "The Mining Companies’ Limited Liability Act Amendment Acts, 1869 and 1870," and I do solemnly and sincerely declare that the following statement is, to the best of my belief and knowledge true in every particular, viz.:

  1. The name and style of the Company is The Hyde Park Gold Mining Company, Registered.
  2. The place of operations is at the Waio.Karaka Creek, at the Thames Goldfields, in the Province of Auckland, in the Colony of New Zealand.
  3. The nominal capital of the Company is One thousand two hundred pounds, in One thousand two hundred shares of One pound each.
  4. The amount already paid-up in cash is Nil.
  5. The name of the Manager is Walter Sully.
  6. The Office of the Company is in Williamson-street, Grahamstown.
  7. The names and several residences of the shareholders, and the number of shares held by each, at this date, are as follows, namely:—
