PROCLAMATION.

Superintendent of the Province of Auckland.

I, THOMAS BANNATYNE GILLIES, Superintendent of the Province of Auckland, by virtue of “The Gold Fields Act, 1866,” and of the powers delegated to me thereunder, do hereby proclaim and declare the Province of Auckland to be a District for the purpose of forming a Mining Board therein, to be elected by persons holding Miners’ Rights, and having held the same for not less than three calendar months, prior to the day of nomination of such Board, and I do hereby prescribe as follows, viz:

  1. The Mining Board for the said District shall consist of seven Members.

  2. Any holder of Miners’ Right within the said Province, for not less than six months previous to the day of nomination, shall be eligible for election as a Member of the Board.

  3. The Senior Warden at Shortland shall be principal Returning Officer, and shall appoint deputy Returning Officers for the several polling places.

  4. The nomination of each of the said Members, shall be in writing, signed by not less than seven electors, and by the Candidate nominated, and shall be in the form hereunto annexed, and shall be delivered to the said principal Returning Officer, before 4 o’clock p.m., on the day appointed for the nomination.

  5. The said Returning Officer shall, on the following day, intimate by public advertisement, the names of the Candidates duly nominated, and if there be no more nominated than seven, shall declare these duly elected, and if a greater number of Candidates than seven be duly nominated, he shall appoint a day on which a poll shall take place, at such polling places as he shall appoint, and if a less number than seven shall be duly nominated, shall appoint a future day, on which a further nomination shall take place, of a sufficient number to complete the number of seven, when, if a greater number than necessary are nominated, a poll shall be appointed.

  6. Any Candidate may, by writing under his hand withdraw at any time before a poll takes place, and if such withdrawal leaves no more than the necessary number of Candidates, no poll shall take place, but the remaining Candidates shall be declared to be duly elected.

  7. In the event of a poll being necessary, there shall be polling places at Shortland, Grahamstown, Tapu, Coromandel, and Auckland, and the poll shall be by ballot.

  8. The poll shall take place on the day appointed by the Principal Returning Officer, between the hours of 9 a.m., and 4 p.m., and at the close of the poll, the principal, and Deputy Returning Officers, shall respectively in presence of at least two electors, proceed to open the ballot box, and reckon up the votes polled for each Candidate, and the Deputy Returning Officers shall forthwith transmit the numbers, together with the voting cards, to the Principal Returning Officer, to be checked by him, and on his ascertaining the total number of votes polled for each Candidate, he shall, by public notice, announce the election of the Candidates having the greatest number of votes.

  9. The Members elected shall hold office for one year, from the date of the declaration of their election, unless disqualified as hereinafter mentioned.

  10. The seat of any Member of the Board shall become vacant, if he shall die, be absent from the Province for more than two calendar months, become bankrupt, neglect to attend three consecutive meet,
