PROCLAMATION.

Superintendent of the Province of Auckland.

WHEREAS by the thirty-ninth clause of The Highways Act, 1867, it is enacted that if any public road or highway shall have become or be useless or of no importance to the public, it shall be lawful for the Superintendent, upon the recommendation of the District Trustees, and with consent of all the owners of land abutting on the said public road or highway, by proclamation in the Provincial Government Gazette to declare that the said road shall, on and after a day to be named in such proclamation, not being earlier than three calendar months from the date thereof, be no longer a public highway:

And whereas the Highway Trustees for the District of Paparoa, Parish of Pakuranga, have recommended to me that the public road described in the Schedule hereunder written and being situate within the boundaries of the said district should be closed, and have communicated to me the consent thereto of all the owners of land abutting on the said public road:

Now, therefore, I, John Williamson, the Superintendent aforesaid, acting in pursuance of such power and authority, and upon the recommendation of the District Trustees and with the consent of all the owners of land aforesaid, do hereby declare that the road described in the Schedule hereunder written shall, on and after the first day of February, 1870, be no longer a Public Highway.

Given under my hand at Auckland, and issued under the public seal of the said Province, this twentieth day of October in the year of our Lord One thousand eight hundred and sixty-nine.

SCHEDULE.

A road 50 links wide on the western side of the village of Howick, commencing at the south-eastern angle of allotment No. 1, and terminating at the south-western angle of allotment No. 5, both of section No. 9 of small lots near the village aforesaid: the said road being bounded towards the North by allotment No. 5 of said section No. 9; towards the East by allotment No. 5 aforesaid, and allotment No. 30 of section No. 1 of the village of Howick; towards the South by Picton-street; and towards the West by allotments Nos. 1, 2, and 4 of said section No. 9 of small lots aforesaid.
