Between JOHN GWYNNETH, Plaintiff, and JOHN HENRY HERBERT ST. JOHN, Defendant
WHEREAS, by virtue of a writ of fi. fa. issued in this action and directed to me, ordering me that of the real and personal estate of the above-named JOHN HENRY HERBERT ST. JOHN, I should cause to be made the sum of £190 1s. 4d., together with interest upon the said sum at the rate of £8 for every one hundred pounds by the year, together with £1 2s., for the said writ and warrant, besides Sheriff’s poundage, officer’s fees, &c., from the fourteenth day of February, 1868: Now I do hereby give notice that I shall cause to be SOLD by public AUCTION, by S. COCHRANE AND SON, at their Auction Mart in Fort-street, Auckland, on the 22nd day of June, 1868, at the hour of twelve o’clock at noon, unless the said debt or sum of £190 1s. 4d. and interest be sooner paid, together with the said sum of £1 2s., besides Sheriff’s poundage, officer’s fees, &c., all that the EQUITY of REDEMPTION and other the ESTATE, Right, Title, and Interest of the said JOHN HENRY HERBERT ST. JOHN, in, and to all that Piece or Parcel of LAND in New Zealand aforesaid, containing by admeasurement Four Hundred Acres more or less, situated in the province of Auckland, parish of Te Papa, Cook’s County, and district of Tauranga, being Allotments Nos. 46, 47, 48, 49, 50, 51, and 59; bounded towards the north-east by a road 100 links wide, 3,925 links, 429 links, 1,548 links, and 1,928 links; towards the north-west by a road of width aforesaid, 552 links, 816 links, 1,133 links, and 1,688 links; towards the east and south-east by a road 800 links, 820 links, and 600 links, and by the Waihore stream; towards the south by lot 54, 4,684 links; and towards the west by a road of width aforesaid, 2,067 links, 1,917 links, 1,511 links, 824 links, and 926 links. And also all that piece and parcel of Land in the said Province of Auckland, parish of Te Papa, Cook’s County, and situated in the town of Greerton, and being lot No. 50, containing by admeasurement one acre more or less, bounded towards the north by a line 500 links, towards the east by a line 200 links, towards the south by lot 49, 500 links, and towards the west by a street 100 links wide, 200 links. And I further give notice that the Estate and Interest of the said JOHN HENRY HERBERT ST. JOHN in the said land consists of an Equity of Redemption of the Freehold, and that the same has been taken by me in Execution at the suit of the said John Gwynneth, the execution creditor.

WHEREAS, by virtue of a writ of Fi Fa issued in this action, and directed to me, ordering me that of the real and personal estate of the above-named JOHN ANDERSON and JESSIE ANDERSON, his wife, I should cause to be made the sum of £113 9s 4d, together with interest upon the said sum at the rate of £8 per centare per annum, together with £1 13s 4d for the said writ and warrant besides sheriff’s poundage, officer’s fees, &c., from the thirty-first day of January, 1868. Now I do hereby give notice that I shall cause to be sold by public auction by S. Cochrun & Son, at their auction mart in Fort-street, Auckland, on the 22nd day of May, 1868, at the hour of twelve o’clock at noon, unless the said debt or sum of £113 9s 4d and interest be sooner paid, together with the said sum of £1 13s 4d, besides sheriff’s poundage, officer’s fees, &c., all the estate, right, title, and interest of the said JOHN ANDERSON and JESSIE ANDERSON, his wife, under a trust deed bearing date the 9th day of May, 1863, made between JOHN ANDERSON of the first part, JESSIE ANDERSON of the second part, and JAMES MACAY and JAMES MATTHEWS therein described of the third part, of in and to all that piece or parcel of land, situated in the Parish of Waiwerawera, in the County of Marsden, and containing by admeasurement seventy-six acres, and being part of allotment number sixty-four; bounded on the north by the Waiwerawera river, and by a part of the same allotment, sold to one Gagin; on the east by a line bearing 155° 20’ 3535 links; on the south by a line bearing 90° 3600 links; and on the west by a line bearing 360° 23 chains, and then by the said Gagin’s land 10 chains. And all that piece or parcel of land in the Parish and County aforesaid, containing forty acres, part of allotment number seven; bounded on the south-west by a boundary line of the said allotment, No. 7, 2000 links; on the north-east by lot No. 8; on the south-east by the boundary line of the said allotment, No. 8; and on the north-west by a line parallel with the south-west boundary line of the said allotment, so as to include forty acres, and all that parcel of land in the Province of Auckland aforesaid containing by admeasure*
