Schedule B to this Act annexed. And whereas the said Road so to be stopped as aforesaid passes through certain Lands the property of the said William Hampton Thorp and Edward Joseph Thorp who have agreed to accept the Lands over which the Road so to be stopped passes in exchange for the Land to be taken for the said new Road.
Be it therefore enacted by the Superintendent of the Province of Auckland by and with the advice of the Provincial Council thereof as follows:
Short Title.
I. The Short Title of this Act shall be βThe Road Act No 1 1866.β
Road to be stopped.
II. From and after the passing of this Act the said Road mentioned and described in the Schedule A to this Act annexed shall be stopped.
Stopped Road may be granted.
III. It shall be lawful for the Governor in the name and on behalf of Her Majesty to grant the land described in the Schedule A to the said William Thorp and Edward Joseph Thorp and their heirs.
Road taken to vest in Her Majesty.
IV. From and after the passing of this Act the fee simple of the Land mentioned and described in Schedule B to this Act shall vest in Her Majesty and the Land shall thereafter be used as and be a Public Highway.
SCHEDULE A.
A Road One Hundred Links in width and Two Thousand Eight Hundred and Seventy Links in length running from the Wairoa River to the Road leading to Papakura through allotments numbers Sixteen and Nine of the Parish of Wairoa bounded towards the north by part of said allotment Number Nine Eight Hundred Links towards the north-west and west by part of said allotment Number Nine Four Hundred and Sixty Links and by parts of said allotments Numbers Nine and Sixteen Four Hundred and Seventy Links and again towards the north-west by part of said allotment Number Sixteen Six Hundred and Sixty Links and Four Hundred and Ninety Links towards the south-east by part of allotment Number Nine Hundred Links towards the east and north-east by part of said allotment Number Nine Five Hundred Links and Four Hundred and Fifty Links again towards the east by part of said allotment Number Sixteen Six Hundred and Twenty Links and again towards the south-east by part of said allotment Number Sixteen Four Hundred Links.
