Sir,—I have the honor, by desire of His Excellency Sir Dominic Daly, to call your attention to the fact that not a single case of Pleuro-pneumonia among cattle has ever been known to exist in this colony; and the dryness of the climate renders it probable that even were the disease introduced it would soon die away of itself; while the stringent regulations adopted to prevent the crossing of diseased Cattle over the frontier of the Province are of the most effective description.

Under these circumstances I am to express His Excellency's hope that you will so far modify the Proclamations issued by you under the diseased Cattle Act as to exempt from their operations Cattle exported from this colony to the Province of Auckland.

Sir,—Referring to my Letter of 15th inst., of which duplicate is sent herewith, I regret to inform you that I have not as yet been able to obtain the official information respecting those districts in this colony, from which Cattle might be exported to your Province without risk of carrying with them the infection of Pleuro-pneumonia.

PROCLAMATION.

By ROBERT GRAHAM, Esquire,

Superintendent of the Province

of Auckland, in the Colony of

New Zealand.

WHEREAS by the “Diseased Cattle Act 1861,” it was provided that the Governor in Council might by Warrant under his hand, from time to time, delegate, to the Superintendent of any Province within the Colony of New Zealand, all or any of the powers vested in the Governor, or Governor in Council, by the said Act, subject to such regulations as he might think fit; and might from time to time rescind such delegation: and whereas the said Governor did with the advice and consent of the Executive Council of New Zealand, delegate to John Williamson, Esq., so long as he should hold the office of Superintendent of the Province of Auckland, the several powers vested in the said Governor by the second, fourth, fifth, seventh, ninth, and tenth sections of the said Act subject to being rescinded as in the said Act provided, and subject to the regulations issued by the Governor in Council on the first day of October, 1861.

And to any other regulations to or from time to time duly made; And whereas the said John Williamson, in pursuance and by virtue of such powers so vested in him did on the 28th day of February, 1862, proclaim and declare that after the date thereof the several Colonies of New South Wales, of Victoria, of South Australia, of Western Australia and Queensland, as well as the Colony of Tasmania and the Colony of the Cape of Good Hope and the Islands of Great Britain and Ireland, should be deemed to be for the purposes of the said recited Act, affected districts within the meaning of the said Act, and no cattle were allowed to be imported from the above mentioned Districts, into the province of Auckland, until further notice; And whereas the said John Williamson has ceased to hold the office of Superintendent of the Province of Auckland; And whereas the said Governor hath with the advice and consent of the Executive Council of New Zealand, and in pursuance and exercise of the said power and authority did by his Warrant under his hand delegate to Robert Graham, Esq., so long as he should hold the office of Superintendent of the Province of Auckland, the several powers vested in him by the said recited sections of the said Act, subject to be rescinded as in the said Act provided, and subject to the regulations issued on the fifteenth day of September, 1862, and to any other regulations to be from time to time duly made; And whereas it is expedient to remove the restriction on the importation of cattle from certain Districts included in the said recited proclamation of the 28th day of February, 1862:

Now therefore, I the said Robert Graham, by virtue of such powers in me vested, do hereby proclaim and declare that from the date hereof, and until further notice, it shall be lawful for all persons to import cattle into the Province of Auckland, from the following places, viz:—The Islands of Great Britain and Ireland, Tasmania and South Australia.

And I further proclaim and declare that the said proclamation of the 28th day of February, 1862, to remain in full force and effect save and except as altered hereby.

Given under my hand at Auckland, this twenty-eighth day of May, one thousand eight hundred and sixty-three.
