BE IT THEREFORE ENACTED by the Superintendent of the Province of Auckland with the consent of the Provincial Council thereof as follows :-

Land described in Schedule to be opened as a Road.

  1. From and after the passing of this Act the Land mentioned and described in the Schedule to this Act shall be opened as a new line of Road, and the same shall for ever thereafter be used as and be a Public Highway.

Superintendent may pay compensation.

  1. It shall be lawful for the said Superintendent from and out of the public revenue of the Province of Auckland to pay to the said Joseph Crispe, J. Clark, Samuel Vickers, The Right Reverend G. A. Selwyn, Bishop of New Zealand, A. E. Crispe, Joseph Giles, William Henry Morley, Theodore Minet Haultain, and James Speedy, their heirs or assigns, such compensation as may be awarded under the provisions of “The Diversion of Roads Act, 1858.”

Short Title

  1. The Short Title of this Act shall be “The Road Act, No. 3, 1862.”

SCHEDULE.

A Road commencing at a point 295 links west of the west side of Parson’s Road which leads through lots 22 and 25 of the Parish of Puni to the Patamahoe Reserve; the said Road being 100 links in width, and running in a westerly and northerly direction through lot 10 of the Parish of Puni; lots 96, 97, 98, 99, 100, and 101 of the Parish of Waiuku East, and lots 17, 18, and 19 of the Parish of Waiau, where it joins the Auckland and Waiuku Road, as the same is marked upon a plan lying in the Waste Land Office, numbered 1,003.
