HEREBY notify for general information that a Writ issued by me on the twenty-eighth day of November last for the election of a Member of the Provincial Council for the District of the Pensioner Settlements, has been returned with an endorsement thereon as follows:—
I, Charles Henry Montresor Smith, the Returning Officer for the Electoral District of the Pensioner Settlements, Province of Auckland, do hereby declare that in pursuance of the Writ to me directed, bearing date the 28th day of November, 1859, the undermentioned Candidate is duly elected a Member of the Provincial Council for the said District.

Sir,—I have the honor to acknowledge receipt of your letter of this day’s date, respecting an alleged encroachment on your land at the Otahuhu Bridge, and to inform you that the Provincial Land Surveyor has been instructed to ascertain the position of the Bridge in relation to your property.

Sir,—I have the honor to report that in pursuance of your instructions of the 8th instant, I proceeded on the 9th to the bridge over the Tamaki, near Otahuhu; built in 1849, and by measurement made there, ascertained that in order to lead the road fairly on to the bridge, and to leave room for any necessary repairs to the parapet, wall, &c., a deflection of the road to the South, commencing about 287 links from the river bank, and diverging to the extent of 17 links, would be necessary. I attach a sketch of such alteration.

Otahuhu, 12th December, 1859.
Sir,—I presume you are already aware of the fact that a portion of the Otahuhu Bridge stands on my land. Being about to commence building on the portion of it immediately adjoining the Bridge, I have thought fit to inform you of my intention, so that the inconvenience which the public may afterwards have to suffer from the carrying out of my plan may not be chargeable to my account for having neglected to forewarn your Honor in time of the project I have in contemplation. Next week God willing I will invite tenders for the erection of a brick house on the spot alluded to, unless your Honor may think fit to enter into some compromise that will compensate me for the loss I sustain by having a portion of the Bridge built on my property.
