Auckland, 26th August, 1859.

Sir,—In reply to your Honor’s letter, No. 131, of the 11th instant, in which you forward and recommend the Code of Regulations, for the setting, disposal, and occupation of the Waste Lands of the Crown in the Province of Auckland, adopted by the Provincial Council during last Session, I have the honor to inform you that these Regulations have been approved by the Governor in Council and that a Proclamation issuing and putting them in force from the first of October next, will be published forthwith.

With reference to the 4th Clause of those Regulations enabling the Governor if he shall think fit, within three months after the extinguishment of the Native Title to any land, to sell and dispose of the same or any part of it, to the person or persons at whose instance such extinguishment shall have been effected, I have the honor by His Excellency’s direction to state that the views of the Imperial Government expressed in the despatch cited in the margin [18th May, 1859,] (published in the New Zealand Gazette of the 27th ult.) on the subject of the “Native Territorial Rights Bill, 1858,” will preclude His Excellency from the exercise of the power conveyed by that clause.

PROCLAMATION.

By His Excellency Colonel Thomas Gore Browne, Companion of the Most Honorable Order of the Bath, Governor and Commander-in-Chief in and over Her Majesty’s Colony of New Zealand, and its Dependencies, and Vice-Admiral of the same, &c., &c., &c.

WHEREAS by an Act of the General Assembly of New Zealand, intituled “The Waste Lands Act, 1854,” it is provided that if the Superintendent and Provincial Council of any Province shall recommend to the Governor any Regulations for the sale, letting, disposal, and occupation of the Waste Lands of the Crown within such Province, it shall be lawful for such Governor, if he shall think fit, with the advice of his Executive Council, by Proclamation in the New Zealand Government Gazette to issue and put in force such Regulations within such Province, on a day to be named in the Gazette in which the same shall be published, not being less than one calendar month from the publication thereof.

And whereas the Superintendent and the Provincial Council of the Province of Auckland have recommended to me the following Regulations for the sale, letting, disposal, and occupation of the Waste Lands of the Crown within the said Province.

Now, therefore, I, the Governor, pursuant to the authority vested in me in that behalf by the said recited Act, do hereby with the advice of the Executive Council, proclaim
