I have to acknowledge the receipt of your Honor’s letter, No. 106, of the 26th instant, in which you inform me that you have issued writs for the election of two members of the Auckland Provincial Council—there being but a single vacant seat in that body.

Sir,—As His Excellency’s Government has refused to dissolve the Provincial Council of the Province of Auckland, and as I consider that the legislation of the Province cannot be satisfactorily carried on for the benefit of the people thereof, by the present Council, constituted as it is;—I therefore beg to resign my seat in your Honor’s Executive Council.
