I HEREBY notify for general information that His Excellency the Governor has been pleased to leave to their operation the undermentioned Acts, passed during the 5th Session of the Provincial Council, viz. :-

"Interpretation Act, 1856."
"Sheep Act, 1856."
"Impounding Act, 1856."
"Merchant Seamen’s Act, 1856."
"Cattle Branding Act, 1856."
"Native Land Purchase Amendment Ordinance."
"The Debentures Act, 1856."
"The Naval and Military Scrip Act, 1856."
"Appropriation Act, 1856."
"Auckland City and Harbour Acts."
"Repealing Act."
"Deeds Registration Act, 1856."
"The City of Auckland Building Act, 1856."

Sir,—I beg to communicate to your Honor the following decision of the late Government, with reference to various Acts passed by the Auckland Provincial Council Session 5 Nos. 5 to 14 as per margin, and transmitted to this office by your Honor.

  1. Merchant Seamen’s Act
  2. Pre-emptive Land Claims Act
  3. Cattle Branding Act
  4. Native Land Purchase Amendment Ordinance
  5. Debentures Act
  6. Naval and Military Scrip Act
  7. Appropriation Act
  8. Auckland City and Harbour Acts
  9. Deeds Registration Act
  10. City of Auckland Building Act

With the exception of the Pre-emptive Land Claims Act No. 6, his Excellency has been pleased to leave these Acts to their operation.

It is observed that by the Cattle Branding Act, and also by the Merchant Seamen’s Act offences are created, and punishments attached, which contravene Sub-section 12 of section 19 of the Constitution Act, his Excellency thinks it right to call the attention of the Provincial Government to this fact, as there is no doubt that the enforcement of penalties, which under the Constitution Act, they had no power to inflict, might involve them in unpleasant consequences with the parties against whom they might be enforced.

The following Letter from the Colonial Secretary in reference to the "Cattle Branding Act" and the "Merchant Seamen’s Act," is published for general information.

With respect to the Pre-emptive Land Claims Act (No. 6) his Excellency is advised that it affects to confer powers on the Governor, while, by indicating a particular line of proceeding, and time for reporting, it, pro tanto, limits the Governor’s authority.
