THE following Bye-Laws of the Auckland Harbour Committee are published for general information.

AUCKLAND HARBOUR BYE-LAWS.

WHEREAS by an Act made and passed by the Superintendent of the Province of Auckland, with the advice and consent of the Provincial Council thereof, No. 11 Sec. 1, it was enacted that the Harbour Committee to be elected by Commissioners appointed under the said Act should have power to make Bye-laws (see clauses 45, 7, and 35) for the good order, government, cleanliness, convenience, and management of the harbour of Auckland, and of any Docks and Piers already or to be thereafter constructed therein.

Be it therefore ordained and declared by the Auckland Harbour Committee as follows:—

BYE-LAWS FOR WHARFAGE OF GOODS.

No. 1. No rates or charges shall be levied in respect of any goods, merchandise, or packages which shall be landed from on board any vessel on the Queen-street Wharf, in the Port of Auckland, or placed thereon for shipment, other than as herein provided by any of the following Bye-laws, or as is contained in Schedule A hereunto annexed, and subject to the provisions therein provided.

No. 2. The rates and charges contained in Schedule A aforesaid, shall be levied on all goods, merchandise, or packages as therein provided for respectively; nevertheless, it shall be competent in any person, duly authorised by the Harbour Committee, to commute for the same at the rate of nine-pence (9d.) per ton in the gross, by Bill of Lading, and according to ship measurement.

No. 3. Goods placed by the person in charge thereof at the time, or by order of the Harbour Committee, under cover of any shed or store of or belonging to the said Harbour Trusts, and until further alteration be made therein in respect of any such charge, shall be charged during the day of 24 hours, or any part thereof, at one shilling (1s.) per ton, or sixpence (6d.) for any less quantity under one ton, and an additional charge of one shilling (1s.) per ton on any less quantity per hour after the limited time for the removal thereof, unless where any special arrangement may have been made otherwise by some duly authorised person.

No. 4. Any goods or packages remaining on the Queen-street Wharf, after notice to remove the same has been given to the person depositing the same, or in charge thereof, shall be liable to a charge of five shillings (5s.) for every three hours, or part thereof, which such goods may be so left: and any goods left on the Tramways, or so as to impede the Trams or the Tramways to or from any other vessel shall pay a further sum of five shillings (5s.) for each and every half-hour so left after notice has been given; and such goods, or any part of them, may be moved by any duly authorised person on behalf of the Harbour Committee, and at the cost and risk of such goods, or the person so depositing the same or the owner.

No. 5. All fees, fines, or charges payable by virtue of any of the Bye-laws or Schedules lawfully published, shall be paid by the owner or agent of the said ship or goods respectively, or by the master of the ship or vessels, or other person by whose act or by whose authority the same has been incurred.

  • Note 1. The use of trams and cranes, so far as the same are in fitting condition and available, and when not required for Harbour Works, will be afforded by the Harbour Committee without extra charge, save and except on goods not paying wharfage.

  • Note 2. The tonnage or measurement of goods, in reference to the goods and Schedule hereto annexed, is deemed and taken to be, and to be understood to mean according to the usage and custom of shipping when not otherwise expressly provided for.
