PROVINCIAL COUNCIL.
TUESDAY, 20th December.
The Council met pursuant to adjournment.
The Speaker took the Chair.
The minutes of the last meeting were read and confirmed.
Mr. Newman gave notice that on Tuesday the 10th January 1854, he would move for leave to bring in a Bill to amend the present Fencing Ordinance.
Mr. Powditch gave notice that at the next meeting of Council he would move that His Excellency the Governor be requested to direct immediate steps to be taken to extinguish the Native Title to such lands on the Waikato River as will include the coal district with a view to its being made available to the public purposes of this Province. And that his Honour the Superintendent be requested by the Speaker of the Council to support the said request by his favorable recommendation.
Mr. Hill gave notice that on the first day of the Council's meeting after the recess, he would move the adoption of the Newmarket Fencing Committee's Report.
Mr. Hill gave notice that at the next meeting of Council, he would move the following resolutions—
1st. That in the opinion of this Council it would be highly conducive to the prosperity of New Zealand, that the powers given by the Constitution Act to the General Assembly to make laws for regulating the sale, letting, disposal, and occupation of the Waste Lands of the Crown should be conferred on the Legislatures of the several Provinces.
2nd. That in the Province of Auckland it would afford great satisfaction to all classes of the colonists that this power should be entrusted at the earliest opportunity to the Provincial Legislature.
3rd. That this above resolution be communicated to His Excellency the Governor, to the Legislative Council, and to the House of Representatives at such time as the Speaker shall deem most suitable.
Mr. Gilfillan gave notice that at the next meeting of Council, he would move that Council go into Committee of the whole on the Supplementary Estimates.
On the Orders of the Day being called on, Mr. Gilfillan (in the absence of Mr. Connell) requested that the first two orders of the day might be postponed, and that Council do go into Committee on Deeds Bill.
The Speaker left the Chair. Mr. Clarke took the Chair.
Clauses 1, 2, and 3, read and agreed to.
Clause 4 as printed, expunged. On clause 5 as printed being read, debate ensued. Mr. Busby moved as an amendment, and Mr. Porter seconded, that further consideration of Bill be postponed.
Mr. Gilfillan moved, Mr. Williamson seconded, that Committee proceed with consideration of Bill.
Committee divided—Ayes 11, Noes 2.
Original question carried in the affirmative.
Clauses 4 and 5 amended and agreed to.
On motion of Mr. Porter the further consideration of Bill in Committee postponed.
