MEMORANDUM.

The Superintendent will in the administration of the Executive Government of the Province, act only by and with the advice and consent of an Executive Council.

The Executive Council shall consist of two members of the Provincial Council, and each such member of the Executive Council shall either hold his seat therein without office or shall hold also such office or offices, and have special charge of such department or departments as shall from time to time be appointed by the Superintendent and confirmed by resolution of the Provincial Council. The Provincial Attorney shall also ex officio hold a seat in the Executive Council, but without the right of voting.

The Superintendent, or in his absence the Deputy Superintendent, shall preside at the sittings of the Executive Council and shall be competent to vote and otherwise take part in the proceedings.

The Provincial Treasurer shall not be required to take charge of the public monies of the Province or to give security for their safe keeping, but the Assistant Treasurer, who shall not be a member of either the Executive Council or the Provincial Council, shall receive and pay all monies for and in behalf of the Province, and shall give security by bond to the amount of £2000 himself in £1000 and two sureties of £500 each or such other sum as the Superintendent may require. The Assistant Treasurer shall not be required to issue or pay any money except upon warrant of the Superintendent countersigned by a member of the Executive Council not being the Provincial Attorney.

Any member of the Executive Council chosen from the Provincial Council shall resign his office when called upon so to do by the Superintendent or by resolution of the Provincial Council.

The Superintendent shall keep the Public Seal of the Province, but shall use it only with the advice and consent of the Executive Council.

No appointment to the Executive Council shall lapse by any dissolution of the Provincial Council; nor until such appointment shall be revoked as hereinbefore provided in clause 5, or another substituted for it.

NOTICE
Appointing places for Exposing Cattle for Public Inspection.

New Plymouth, March 22, 1866.
IN exercise of the power vested in the Superintendent by “The Branding of Cattle Ordinance, 1865,” I do hereby declare that I have appointed the places below specified to be places at which cattle shall be exposed for public inspection in accordance with the provisions of the said Ordinance:—
The Stockyard on T. King’s Farm,
Lower Mangorei.
The Stockyard on Z. Wells’ Farm,
Lower Mangorei, (No. 775, Grey District).
The Stockyard on W. Wells’ Farm,
Upper Mangorei, (No. 779, Grey District).

ORDER IN COUNCIL.
At the Government House, at Wellington, the twenty-third day of February, 1866.
Present:
His Excellency the Governor in Council.
WHEREAS by “The New Plymouth Exchanges Commission Act, 1865,” it is amongst other things enacted that it shall be lawful for the Governor in Council, from time to time, to appoint one or more fit person or persons to be a Commissioner or Commissioners for the purposes therein mentioned.
And whereas by the said Act it is further enacted that it shall be lawful for the Governor in Council, in and by any and every such Commission, to order and direct that the powers and duties of the Commissioner or Commissioners therein named, shall be exercised and performed and the business of the Commission conducted according to regulations to be at any time and from time to time made and prescribed by any Order or Orders in Council, and such regulations may be made and prescribed by any Order or Orders in Council accordingly.
And whereas in pursuance and exercise of the said power and authority, His Excellency the Governor has by Commission bearing even date herewith appointed
