WHEREAS by the ninth section of “The Secondary Punishment Act, 1854,” it is enacted, that every person, except as hereinafter mentioned, who shall be kept in penal servitude shall, during the term of his servitude, be employed on the roads or public works, or otherwise be kept to hard labour, in such part of the Colony of New Zealand as the Governor shall in that behalf direct, and either in irons or under such other restraint, and subject to such correction as may be necessary for his safe custody and strict discipline; and for the purpose of being so employed as aforesaid, every such convict may be removed from place to place, either by sea or land, and may be confined in such public gaol, at such penal station, or in such place of confinement, or may otherwise be kept in custody, as the Governor may from time to time direct:

And whereas, by the seventeenth section of the said Act it is enacted, that it shall be lawful for the Governor, by instructions under his hand, to delegate to the Superintendent of any Province, on such terms and conditions, and subject to such limitations and restrictions as may be prescribed in that behalf, all or any of the powers thereinbefore reserved to the Governor by the ninth clause of the said Act:

And whereas it is expedient that the powers reserved to the Governor by the said ninth section of the said Act should, so far as the same are exercisable with regard to persons sentenced to penal servitude by any court of competent jurisdiction sitting within the Province of Auckland, and so far as the same are exercisable with regard to persons sentenced to penal servitude by any court of competent jurisdiction sitting and acting beyond the limits of the said Province, and removed under lawful authority to any prison within the said Province, should be delegated to the Superintendent of the said Province:

Now, therefore, I, Sir James Fergusson, Baronet, the Governor of New Zealand, in exercise and pursuance of the powers vested in me by the said seventeenth section, do hereby, by this instrument under my hand, delegate to

JOHN WILLIAMSON, ESQUIRE,

so long as he shall hold the office of Superintendent of the said Province, all the powers reserved to the Governor by the ninth section of the said Act, but only so far as the same are exercisable with regard to persons heretofore or hereafter to be sentenced to penal servitude by any court of competent jurisdiction sitting and acting within the said Province, and so far as the same are exercisable with regard to persons heretofore or hereafter to be sentenced to penal servitude by any court of competent jurisdiction sitting or acting beyond the limits of the said Province, upon such persons being removed under lawful authority to any prison within such Province.

Given under the hand of His Excellency the Right Honourable Sir James Fergusson, Baronet, a Member of Her Majesty’s Most Honourable Privy Council, Governor and Commander in Chief in and over Her Majesty’s Colony of New Zealand and its Dependencies, and Vice-Admiral of the same, this sixth day of December, in the year of our Lord One thousand eight hundred and seventy-three.

ROAD BOARD GRANT.

The following Scheme for Distribution of the Road Board Grant allotted to the Province of Auckland, for the year ending 30th June, 1874, having been approved by His Excellency the Governor, is published for general information.

Total Amount allocated to Province, £11,954; less about one-tenth to be reserved for new Boards and Out-lying districts, £1,100; balance, £10,854, divisible among Boards in proportion to the amount of Rates and Voluntary Subscriptions raised by each Board during the year ended 30th June, 1873, as follows:

Class I. Wealthy Districts near town, 4s. 7d. per £—

  • Grafton Road, £57 8s.; Karangahape, £94 3s.; Parnell, £162 18s. Total—£322 9s.

Class II. Settled Districts within a reasonable distance from town, 9s. 2d. per £—

  • Devonport, £75 7s.; East Tamaki, £81 16s.; Kaipara, £388 8s.; Mangarei, £56 12s.; Mount Albert, £64 17s.; Mount Eden, £133 11s.; Mount Wellington, £68 1s.; Newmarket, £72 13s.; Newton, £96 9s.; One Tree Hill, £103 7s.; Otahuhu, £32 6s.; Panmure Township, £5 5s.; Ponsonby (including Dedham), £165 3s.; Remuera, £187 11s.; Tamaki West, £70 7s.; Tararu, £85; Town of Onehunga, £104 14s.; Waiotahi, £520 15s.
